Regulatory Proposal: Harmonization of Municipal Road Construction

The Ministry of Transportation is proposing a regulation under the Public Transportation and Highway Improvement Act, 1990, that would provide the Minister with regulation-making authority to govern contracts about road and bridge construction (including contracts between municipalities and third-party contractors), establish reporting requirements,  and establish a process for requesting an exemption from the application of a standard. 

The proposed Minister’s regulation would mandate Ontario Provincial Standards for Municipal Road Construction (OPSS.MUNI) with respect to hot mix asphalt, aggregates and drainage, and the use of standard contractual terms and conditions, and establish a transition process and exemption request process. 

Of particular interest to our members, the proposed regulation would establish an annual reporting requirement for municipalities to provide information to the Ministry of Transportation on the application of mandatory standards. 

The proposal is open for comment until March 30, 2026.
