The Ministry of the Attorney General is proposing changes to Ontario Regulation 747/21 “Permits” under the Liquor Licence and Control Act, 2019 to expand the definition of “tailgate event” to include cultural and community events.
Tailgate event permits can be issued as either “sale” or “no-sale” permits depending on whether alcohol will be sold and served. Unlike other public event permits issued by the Alcohol and Gaming Commission of Ontario (AGCO), tailgate event permits allow attendees to bring and consume their own alcohol. Currently, tailgate event permits are limited to outdoor public events held in connection with and near eligible live sporting events.
Applicants would be required to obtain a letter or resolution from the relevant municipality confirming the event’s status as a “cultural or community event” before submitting their application to the AGCO.
The proposal is available for comment on Ontario’s regulatory registry until November 11, 2025.
